Your Salon Manager — Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Your Salon Manager platform operated by HOLLY’S HAIRCARE SUPPORT PTY LTD(ABN 77 676 534 446), trading as The Salon Circle (“The Salon Circle”, “we”, “us” or “our”).

By creating an account, accessing or using the platform, you agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the platform.

1. About the Platform

Your Salon Manager is a cloud-based business management and business intelligence platform designed for salon businesses.

The platform may include features such as:

  • Business dashboards
  • KPI tracking
  • Team management tools
  • Goal setting and performance tracking
  • Revenue and profitability analysis
  • Forecasting tools
  • Business analytics
  • AI-powered chat and insights
  • Task management
  • Business resources and educational content

Features may be added, removed, modified or discontinued at any time, particularly during Beta testing periods.

2. Eligibility

You must be at least 18 years old to create or use an account.

You warrant that:

  • You have authority to enter into these Terms;
  • Any information you provide is accurate and current;
  • You will keep your account information updated.

If you are creating an account on behalf of a business, you warrant that you have authority to bind that business to these Terms.

3. Account Responsibilities

You are responsible for:

  • Maintaining the security of your account;
  • Maintaining the confidentiality of login credentials;
  • All activity occurring under your account;
  • Ensuring only authorised users access the platform.

You must immediately notify us of any suspected unauthorised access or security breach.

We reserve the right to suspend or terminate accounts where we reasonably believe security has been compromised.

4. User Data

Users may enter and store information including:

  • Business information;
  • Employee information;
  • Wage and commission information;
  • KPI and performance data;
  • Revenue, cost and profitability data;
  • Rosters, goals, targets and task information.

You are solely responsible for ensuring you have all necessary rights, permissions and authority to collect, store and process any information entered into the platform.

The Salon Circle does not verify the accuracy, legality or completeness of any information entered by users.

5. Artificial Intelligence Services

The platform includes AI-powered functionality provided through third-party technology providers.

AI-generated outputs may include:

  • Business insights;
  • Forecasts;
  • KPI observations;
  • Growth plans;
  • Coaching suggestions;
  • Marketing content;
  • Pricing observations;
  • Team development suggestions;
  • Other generated content.

AI-generated outputs are provided for informational purposes only.

The Salon Circle does not guarantee the accuracy, completeness, reliability or suitability of any AI-generated content.

Users remain solely responsible for evaluating any AI-generated information and for making their own business decisions.

AI-generated outputs should not be relied upon as financial, accounting, taxation, legal, employment, HR, marketing or other professional advice.

The Salon Circle does not provide professional financial, legal, accounting, employment, HR, business consulting or other advisory services.

Any decisions made using information generated by the platform are made entirely at the user’s own risk.

6. Beta Services

Certain features of the platform may be provided as Beta Services.

Beta Services are provided on an “as is” and “as available” basis.

You acknowledge that Beta Services may:

  • Contain errors, bugs or defects;
  • Experience downtime or interruptions;
  • Change without notice;
  • Be modified or discontinued;
  • Produce inaccurate outputs.

The Salon Circle will use reasonable efforts to maintain and improve Beta Services but makes no guarantees regarding availability, functionality or performance.

Beta access may be provided free of charge or at discounted rates at our discretion.

Feedback provided during Beta testing may be used by The Salon Circle without restriction or compensation.

7. Data Ownership

You retain ownership of all data submitted to the platform.

By using the platform, you grant The Salon Circle a non-exclusive licence to host, process, analyse, store and display your data for the purpose of providing the services.

The Salon Circle acquires no ownership rights in your business data.

All intellectual property rights in the platform, software, systems, workflows, templates, content, branding and technology remain the exclusive property of The Salon Circle.

8. Limitation of Liability

To the maximum extent permitted by law, The Salon Circle excludes all liability for any indirect, incidental, special, consequential or economic loss arising from or related to use of the platform.

This includes, without limitation:

  • Loss of revenue;
  • Loss of profits;
  • Loss of business opportunities;
  • Loss of goodwill;
  • Loss of productivity;
  • Business interruption;
  • Decisions made in reliance upon AI-generated outputs.

To the maximum extent permitted by law, The Salon Circle’s total aggregate liability arising from use of the platform shall not exceed the fees paid by the user during the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes any rights that cannot lawfully be excluded under Australian Consumer Law.

9. Cancellation and Termination

Users may cancel subscriptions at any time through their account or by contacting support.

Cancellation will take effect at the end of the current billing period.

No refunds will be provided for unused portions of subscriptions except where required by Australian Consumer Law.

Annual subscriptions are non-refundable once commenced except where required by Australian Consumer Law.

Following cancellation, data may be retained for up to ninety (90) days before permanent deletion.

Users may request export of their data before deletion.

10. Governing Law

These Terms are governed by the laws of Queensland, Australia.

Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
